Terms and Conditions

General Terms and Conditions

Effective from: 13 September 2026

These general terms and conditions apply to all accommodation and related services arranged by Croatia Uncovered s.r.o. and form an integral part of the contractual relationship between the customer and the agency. The legal relationships established by these terms are governed by Act No. 89/2012 Coll., the Czech Civil Code, as amended, and by other applicable legislation of the Czech Republic.

1. Introductory Provisions

The customer is a natural or legal person for whose benefit the booking is created and the contractual relationship established. Persons under 15 years of age may use the services only when accompanied by an adult (over 18 years of age). If the accompanying person is not their legal guardian, the written consent of the legal guardian is required. Persons aged 15 to 18 travelling on their own may use the services only with the written consent of their legal guardian.

2. Formation and Performance of the Contractual Relationship

The contractual relationship takes effect when the customer submits a binding order, the agency accepts that order, and the deposit is subsequently paid to the agency's account by the deadline stated in the payment instructions. If the customer fails to pay by the stated deadline, the agency treats the customer as no longer interested and cancels the booking.

By submitting the order, the customer confirms that they have read these general terms and conditions and fully agree with them. The customer also confirms that they have familiarised themselves with all characteristics of the service provided (including the photographs and descriptions published on the website) and that they have no health or other limitations preventing them from using the service.

3. Price and Payment for Services

The price includes accommodation only, unless the offer description states otherwise. The tourist tax and any other surcharges listed in the price list are paid separately, directly to the accommodation provider on site. Failure to meet payment deadlines or incomplete payment entitles the agency to withdraw from the contractual relationship and cancel the booking; in such a case the agency's claims to cancellation fees remain unaffected.

4. Payment Terms

For selected properties, the customer pays the agency only a deposit (the percentage stated with the property) and pays the remaining balance directly to the accommodation owner in cash in euros on arrival. For all other properties, the customer pays a standard deposit of 50 % of the total price at the time of booking and the remaining 50 % to the agency's account no later than 45 days before arrival (for bookings made less than 45 days before arrival the full amount is payable immediately). The specific payment method and the amount of the deposit and the balance are always stated with the detail of each property and subsequently in the payment request. The services become duly claimable once the deposit has been paid in full to the agency and the remaining amount paid to the accommodation owner on arrival, or once the full price has been paid to the agency's account, depending on the payment model of the chosen property.

5. Rights and Obligations of the Agency

The agency is obliged to provide the arranged services in accordance with the confirmed booking and to inform the customer of any material changes to the services.

The agency will send the customer the complete booking confirmation containing the accommodation provider's contact details (the owner's name, telephone number and the exact address of the property), the specification of the services and the stay instructions no later than 7 days before arrival, provided that the required payment (the deposit or the total price, according to the payment model) has been duly paid. If the booking is made less than 7 days before arrival, the agency will send this complete booking confirmation immediately after payment of the total price of the stay (or of the required deposit).

6. Rights and Obligations of the Customer

The customer has the right to receive the guaranteed and paid-for services, to request information about the ordered services, to be informed of changes, to withdraw from the contractual relationship before the services commence, and to complain about the services in accordance with applicable law and these terms.

The customer is obliged to provide truthful and complete information, to supervise children under 15, to report all travelling children, to pay the agreed fees, to verify the details in the booking confirmation, to present the confirmation to the accommodation owner on arrival, to arrive on time with the required documents, to comply with the house rules, and to hold valid travel documents.

7. Accommodation

The accommodation is intended exclusively for the agreed number and composition of persons stated in the booking confirmation. Property owners are entitled to refuse to accommodate additional persons or undeclared pets, or to charge surcharges for them according to the price list.

8. Arrival and Departure

Check-in: between 14:00 and 18:00 on the first day of the stay (unless the booking confirmation states otherwise).
Check-out: by 10:00 on the final day of the stay.

If arrival after 18:00 is expected, the customer must inform the property owner or the agency without delay. If the customer neither makes contact nor arrives by 18:00 on the first day and has not agreed a later arrival, the booking may be cancelled with no entitlement to compensation.

9. Changes to the Contractual Terms

The agency may propose changes to the agreed terms where objective circumstances require it. The customer may accept the changes or withdraw from the contractual relationship (cancel the booking) within 5 days of receiving the proposal. If the customer does not reply within that period, the proposed changes are deemed accepted.

10. Withdrawal from the Contractual Relationship (Booking Cancellation)

The agency may withdraw from the contractual relationship where it is objectively impossible to provide the services or where the customer materially breaches the agreed terms.

The customer may withdraw from the contractual relationship:

if they disagree with changes to the terms proposed by the agency (the agency will offer an alternative or refund the amounts paid),
if the agency breaches the agreed terms (with entitlement to a refund of the amounts paid),
for any other reason or without stating a reason, but with the obligation to pay the agency the cancellation fees under Article 11.

11. Cancellation Fees

The amount of the cancellation fee is determined by the date on which written notice of withdrawal is delivered to the agency and is calculated as a percentage of the total price of the accommodation (the booking).

Standard cancellation terms:

90 or more days before arrival: 20 % (min. CZK 1,500 / EUR 60)
60–89 days before arrival: 30 %
30–59 days before arrival: 50 %
14–29 days before arrival: 75 %
0–13 days before arrival or failure to arrive: 100 %

Different cancellation terms may apply to certain properties. Any such specific terms are always expressly stated with the detail of the property on the website and in the booking confirmation.

12. Complaints about Services

If the customer identifies a defect in the accommodation service provided, they must report it without undue delay, primarily directly on site to the property owner, so that it can be remedied immediately. If the owner does not remedy the defect, the customer shall contact the agency without delay. If the customer does not report the defect without undue delay directly on site and does not allow the accommodation provider to arrange a remedy (for example additional cleaning or the repair of equipment), their claim to a price reduction lapses on the grounds of failure to fulfil the duty to prevent damage.

The customer is entitled to exercise rights arising from defective performance with the agency within the statutory limitation period. The agency is not liable for damage caused by the customer's own conduct, by a third party not involved in the provision of the services, or by force majeure.

Out-of-court settlement of consumer disputes:

The body competent for the out-of-court settlement of consumer disputes arising from the arrangement of accommodation is the Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, Czech Republic, e-mail: adr@coi.cz, web: adr.coi.cz.

13. Supplementary Provisions

Evening entertainment and nearby restaurants and bars may generate the usual tourist noise; this does not reduce the quality of the services and cannot be the subject of a complaint. The agency is not liable for temporary pollution of beaches or the sea caused by weather conditions. Insects and small wildlife may occur in this climate zone and should be reported to the property owner where necessary.

Customers are obliged to comply with the house rules of the accommodation and to observe quiet hours. In the event of a serious breach of the house rules, the owner may remove the customer from the accommodation without compensation. In such a case the agency bears no liability towards the customer. The agency does not guarantee access for pets to public beaches. Air conditioning must be used in accordance with the owner's instructions (only while guests are present in the unit and with the windows and doors closed).

14. Special and Final Provisions

The agency processes customers' personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the applicable legislation of the Czech Republic. Detailed information on the principles of personal data processing and protection is available at https://croatiauncovered.com/en/privacy.

The services provided by the agency correspond to the description published on the website at the moment the order is submitted. The details stated in the booking confirmation and in the stay instructions sent to the customer are binding for the scope and conditions of the services provided. Any obvious inaccuracies, printing errors or typos in the description or price of the accommodation on the website are binding on neither the agency nor the customer where they constitute an evident error.

15. Intellectual Property Rights

The information, photographs and materials published on the website are intended exclusively for the personal, non-commercial use of customers. Any modification, copying, distribution, publication or resale of the content without the prior written consent of the copyright holder is prohibited.

16. Concluding Provisions

These terms take effect on 13 September 2026 and supersede all previous versions of the general terms and conditions.
